What if collection agency is wrong

Were human, too, and we make mistakes. He or she also cannot falsely claim to be an attorney or law enforcement official, talk to anyone but you or your attorney about your debt or threaten to sue you unless the collection agency really intends to take legal action against you.

If you are receiving repeated phone calls from a debt collector or if he or she is calling you at work, there is a way to stop this. You can find an example of this letter by clicking on this link. This link will take you to a webpage where you will not only find a sample letter but also a short video explaining the letter and why you should use the template. Once a debt collection agency receives your cease and desist letter it is allowed by law to contact you just once more.

This is to either tell you that it will no longer be contacting you or that it intends to take some legal action against you. Of course, a debt collection agency can continue to contact you even after you send a cease and desist letter and many of the worst ones will. If this happens, your best recourse may be to sue the agency. And as noted above, you can also file a complaint against the agency with the Consumer Financial Protection Bureau.

The best way to protect yourself against identity theft and being erroneously targeted by debt collection agencies is to get and review your credit reports on a regular basis. The law requires the three credit bureaus Experian , Equifax and TransUnion to provide you with your credit reports free once a year.

There is also the website www. Almost always such a search would narrow down to just one person. Even if two people, narrowing that down would not be hard with just a bit more info. From that you might get phone number, address, DOB, DL, email, and all kinds of other info, current and past, accurate and inaccurate but plausibly accurate since it comes from the same source. So what's a debt collector to do? Simple: do not divulge the SSNL4.

Just ask the person being called if they ever did business with XYZ. A lying deadbeat isn't going to tell the truth no matter what is divulged. Debt collectors already know that. Well, in my initial letter to them asking for validation of the debt, I told them all efforts to collect the debt must cease for 30 days while I review the material they send me and said all communication from there on out had to be in writing. To my knowledge, we have received no phone calls from them we don't answer calls if we don't recognize the number and they have left no messages.

After writing the debt validation letter, they sent me a letter simply stating that the debt belonged to someone with the SSN xxx-xx But they didn't send any proof or anything. When I didn't respond, they sent a photocopy of the credit card bill. So, I will write them a letter telling them the debt is not hers, that it's not her SSN and this is not her address and they need to cease all communication from this point out.

Be sure to acknowledge that they sent you someone ELSE's credit card statements and that your daughter did not make any such charges.

It is a fact that most debtors sell their debtors accounts to third party collection companies but in your case where your husbands daughter is a minor and does not owe a debt to anyone, its more like some "debt buyers" have mistaken you for someone and are now trying to scam you or extort money from you.

They are those who purchase old debts for a few buck from creditors and collect for them for a really huge profit. More often that not, they are those who employ strategies that violates the FDCPA or the rights of the consumers to a fair debt collection practices.

They will do everything and anything just to be able to get money from you. But, don't worry too much because there are many ways you can do so you can get rid of these junk debt buyers. The next time they call, try to know more about whose calling you and ask for their location. If possible, record the conversation especially if they are calling you several times in a day or week and if they are using profane, obscene and abusive language because that will be your leverage in fighting them back.

You can or may sue them for harassment and violation of the FDCPA if they still continue to contact you after you send them a cease and desist letter via certified mail.

See the red? That's the violation. The rest is irrelevant. The collector should not say that until they have verified they are speaking to the correct person. Share More sharing options Followers 0. Minors can not enter into contracts, they are SOL. Flyingifr Posted July 17, Coltfan Posted July 17, Guest usctrojanalum Posted July 17, Posted July 17, edited. Based on your situation, I would include the following facts in your Cease Communication letter, but it's only as a courtesy to them: - the Jane Doe they are trying to reach does not live at your address - the Jane Doe they are trying to reach has a different SSN than the person you are related to - the Jane Doe you are related to was a minor at the time the debt was incurred.

Just say the one they have doesn't match hers. They probably hacked the Hospital records to get what info they had and made up the Lab Co. What do I do if they wont give me any additional information like their address etc, I only have the name when I call in and the contact number.

I've asked several times and they hang up. It is a false debt, and they keep calling myself, parents and sister off and on over the last year. Any suggestions, thank you. This company has no phone , yet they have sent a invoice I guess to my bank and it was taken electronically from my account. I received a call from a debt collector several times who already nknew my previous address the last 4 digits of my social but refused to tell me what the debt is for then hung up when I told him I would report him for harrassment.

How did he get my info without needing giving it to him. How can I get a Validation notice without giving them my real address I believe they do not even have my real address and phone.
